3.2.2.1 The Institution's Mission
Bossier Parish Community College is in compliance with this comprehensive standard because the legal authority and operating control of the College are clearly defined for the College's mission. The Louisiana Constitution, Article VIII, Section 5A created the Louisiana Board of Regents (BOR) to coordinate all public higher education in Louisiana. The Louisiana Board of Regents Governance Structure indicates specifically the postsecondary schools which fall under the Louisiana Board of Regents. Additionally, Louisiana Constitution, Article VIII, Section 7.1 A created the Board of Supervisors of Community and Technical Colleges under which states, "Creation; Powers; Institutions; Divisions. (1) The Board of Supervisors of Community and Technical Colleges is created as a body corporate to manage the Louisiana Community and Technical College System subject to powers vested by this Article in the Board of Regents. The system shall include all programs of public postsecondary vocational-technical training, and, as provided by law, institutions of higher education which offer associate degrees but not baccalaureate degrees and such programs and institutions shall be supervised and managed by the board. The system shall be comprised of two divisions, the vocational-technical division which shall include all public postsecondary vocational-technical schools and the community college division which shall include the community colleges in the system."
Moreover, the Bylaws of the Board of Supervisors of LCTCS 1 states that "the mission of the Board of Supervisors for the Louisiana Community and Technical College System shall be to direct, control, supervise, assist and manage the institutions of this System in providing quality education and workforce training to the people of the state."
The Bylaws of the Board of Supervisors of LCTCS Article I, Section 3 outlines the Authority of the Board stating, "the corporate authority, internal and otherwise, vested in the Board of Supervisors of the Louisiana Community and Technical College System to supervise and manage the systems under its jurisdiction, extends to all the colleges, branches, centers of learning or extensions of the system now existing or hereafter established."
The Bylaws of the Board of Supervisors of LCTCS Article IV, Section 2 outlines the Duties of the President. Specifically, the Bylaws of the Board of Supervisors of LCTCS Article IV, Section 2 C states, "the President defines the mission of each campus in the System and allocates functions and programs to each. S/He establishes administrative policies and procedures and implements educational policies. S/He coordinates the activities among and between the various campuses of the System and prepares and presents consolidated budgets, both capital and operating, on behalf of the System . . ."
3.2.2.2 The Fiscal Stability Of The Institution
Bossier Parish Community College is in compliance with this comprehensive standard because the legal authority, Louisiana Community and Technical College System (LCTCS), clearly defines the policies for fiscal stability of the institution. In accordance with the primary functions of LCTCS outlined in Comprehensive Standard 3.2.2.1, the Bylaws of the Board of Supervisors of the LCTCS Article III, Section C specifies that the Board's Other Powers, Duties, and Functions shall have the authority to:
- Sue and be sued, including the right to recover all debts owed to the Board or to any institution under its management, and to retain legal counsel.
- Actively seek and accept donations, bequests, or other forms of financial assistance for educational purposes from any public or private person or agency and to comply with rules and regulations governing grants from the federal government or any other person or agency not in contravention of the Constitution and laws of Louisiana.
- Receive and expend or allocate for expenditure to the institutions under its jurisdiction all monies appropriated or otherwise made available for purposes of the Board and/or the institutions under its jurisdiction.
- Borrow money and issue notes, bond or certificates of indebtedness for the same and pledge fees, rents and revenues to guarantee payment thereof, in accordance with the law and with approval of the State Bond Commission.
- Determine the fees which shall be paid by students and maintain in the System Office, as a public record available on request, a current schedule of such charges.
- Purchase land and purchase or construct buildings necessary for the use of its institutions, in accordance with applicable state laws.
- Purchase equipment and properly maintain and make improvements to facilities necessary for the use of its institutions in accordance with applicable laws.
- Lease land or other property belonging to it or to any of the institutions within the System, in accordance with state laws.
- Sell or exchange land or other property not needed for institutional purposes, in accordance with state law.
- Employ and approve employment, fix or approve salaries, fix or approve the duties and functions of personnel for the System Office and for its institutions, maintain in the System Office a current list of approved salaries.
- Accept and approve curricula and programs of study.
- Adopt, amend or repeal rules and regulations necessary or proper for the business of the Board and for the governance of the institutions under its jurisdiction.
- Adopt, amend or repeal rules and regulations for the governance and discipline of students.
- Affiliate with any institution giving any special course of instruction upon such terms as the Board deems appropriate, which terms may include the retention by such institution of the control of property, faculty and staff.
- Award certificates, confer degrees and issue diplomas certifying the same, as well as adopt, amend or repeal rules and regulations pertaining to the conferring of degrees.
- Enter into contracts and agreements with other public agencies with respect to cooperative enterprises and undertakings relating to or associated with its institutions' purposes and programs.
- Perform such other functions as are necessary or incidental to the supervision and management of its institutions.
- Elect the head of institutions as prescribed by law.
- Employ such technical and professional assistance as needed.
- Assign, designate or determine the name of, or rename, any institution or building under the jurisdiction of the Board, subject to law.
- Review and approve any action the Board deems necessary at the institutional level.
- Perform other duties and actions as prescribed by law and/or deemed necessary for the efficient operation of the System.
The Bylaws of the Board of Supervisors of the LCTCS Article IV, Section 3 D specifies that the "Chancellors for each community college and the Louisiana Technical College shall be appointed by the Board upon recommendation of the President, and hold office at the pleasure of the Board. S/He is responsible to the Board, through the President, for the effective execution of all state laws, all resolutions, policies, rules and regulations adopted by the Board for the administration and operation of the System and the governance of all its campuses. The Chancellor shall administer the college for which he is appointed and shall exercise complete executive authority, subject to the direction and control of the President and the Board. The Chancellor's discretionary power shall be broad enough to allow him/her to meet his/her extensive responsibilities. In performance of his/her duties and responsibilities, the Chancellors shall have direct access to the President. S/He shall be the official conduit of communication between the President and all personnel on his/her campus. The Chancellor shall be responsible to the President for the budgets of his/her campus. This shall include the functions of review and recommendation on the budgets of all divisions of the campus and preparation of a consolidated budget, as well as execution of the budget as approved by the President and the Board."
3.2.2.3 Institutional Policy
Bossier Parish Community College is in compliance with this comprehensive standard because the College's management board, the Louisiana Community and Technical College System (LCTCS), clearly defines the policies concerning related and affiliated corporate entities and all auxiliary services. The LCTCS Bylaws Article III, Sections B and C defines the primary functions of the Board as follows: " Board shall determine broad administrative and educational policies for the conduct of all Board, System and institutional affairs and shall provide for the execution of its policies by the System President and by the institutional chancellors." This section of the LCTCS Bylaws also addresses a number of policy issues. These include the following:
- Determine the fees which shall be paid by students and maintained in the System Office, as a public record available on request, a current schedule of such charges.
- Purchase land and purchase or construct buildings necessary for the use of its institutions, in accordance with applicable state laws.
- Purchase equipment and properly maintain and make improvements to facilities necessary for the use of its institutions, in accordance with applicable laws.

3.2.2.4 Related Foundations
Bossier Parish Community College is in compliance with this standard because the Louisiana Community and Technical College System (LCTCS), the legal authority for the System, clearly defines foundations and other corporate entities whose primary purposes are to support BPCC and/or its programs. LCTCS Policy # 5.017 - Foundations provides operation guidelines for private, non-profit foundations supporting the mission and activities of LCTCS and its colleges.
The purpose of the BPCC Foundation (BPCC Foundation Articles of Incorporation 3) is to promote the educational and cultural welfare of the College and to expand and improve upon the College's mission of providing quality education for the citizens of Louisiana. By hosting fundraising events and activities to raise monies that will assist the College, the Foundation is able to provide additional student scholarships and provide financial resources to faculty and staff for professional development (Sponsoring faculty and staff professional development workshops and conferences, for example). The BPCC Foundation Bylaws 4 indicate a certified public accountant or business manger will audit annually the accounts of the Foundation. The auditor shall report to the Board of Directors and will also submit a copy of the audit to the LCTCS Office no later than the deadline approved by the LCTCS Policy # 5.012 - Annual Financial Reporting.
The purpose of the Cavalier Athletic Foundation (Cavalier Athletic Foundation Bylaws Article III, Section A) is to host fundraising events and activities to raise monies to support the BPCC Athletic Department and its athletic programs. The Cavalier Athletic Foundation Bylaws Article VI, Section E indicate that the Treasurer shall be the chief financial officer of the Foundation and shall have custody of all the books of account monies and securities of the Foundation. Additionally, it notes that all financial reports will be submitted to the auditing firm for approval. In addition, a copy of the audit report is sent to the LCTCS Office no later than the deadline approved by the LCTCS Policy #5.012 - Annual Financial Reporting.
In summary, Bossier Parish Community College is in compliance with 3.2.2.1, 3.2.2.2, 3.2.2.3, and 3.2.2.4 because the Louisiana Constitution, the Louisiana Board of Regents, and the Louisiana Community and Technical College System clearly define the mission, the fiscal policies, institutional policies, and policies governing related foundations under which the College operates. The legal authority and operating control of the institution is in accordance with the Louisiana Constitution and the Louisiana Board of Regents Governance Structure. Louisiana Community and Technical College System (LCTCS) bylaws define the LCTCS Board of Supervisors' role of supervision and management of the institutions of its system (Article I, Section 3 and Article IV, Section 2); policies for the College's fiscal stability (Article III, Section C and Article IV, Section 3 D); and policies concerning related and affiliated corporate entities and all auxiliary services (Article III, Sections B and C). Louisiana Community and Technical College System (LCTCS) bylaws and policies also define the role of foundations and other corporate entities whose primary purposes are to support the institution and/or its programs (Policy #5.017 - Foundations and Article III, Section A).
